Hello all,

I am managing a friend's property and I was wondering do I need to sign the lease or should the lease be signed only between tenant and landlord. and if I dont have to sign the lease shuould I have to mention me as property manager on the lease? I would think I should be mentioned with contact details for tenant to know who the property manager is, but I also wonder what if the landlord decides to remove me as property manager and appoint someone else? would they need to resign the lease?

@Debbie C. Thank you Debbie for your input. I have given charging upfront a thought. I am not sure if it's legal in my market. I am in Connecticut. What market are you in?

Hello,

I have been thinking about this a lot. When a tenant moves out, they usually clean as per what they think is clean. There is always some things left behind. things like inside stove, refrigerator, inside the Owen, corners, some cabinet shelves, window frames some residue on the walls etc. I always find lot of things that could be cleaned better. And I always end up calling professional cleaning service to get a deep cleaning to ensure the tenant moving in does not complain about the property being not clean.

I am wondering is it really landlord who need to bare the cleaning expenses between the tenants? I have tried to deduct some amount from deposit to cover the cleaning fees, but some tenants were bitter about that. They say, they already spend so much time cleaning the place and now they don’t want to lose the cleaning fees from deposit. But again, its never in a condition that a moving in tenant would be ok. How do you tackle this situation? I am now thinking to include in my lease that the property has been professionally cleaning before the lease, so I recommend to have a professional clean the property before moving out. I am not enforcing to get professionally cleaned but I am only recommending. Your input and suggestions are greatly appreciated.

Hello All,

I own few properties which are titled under my LLC. I am now wondering if I have been signign my lease the right way. So, The first line of the lease lays out the parties- "Landlord and Tenant", where the Landlord is mentioned as the LLC. I believe that is the right way since the property owner is the LLC not me. But, what I am wondering is, on the bottom of the lease, under the signature line should I write the LLC name or my name, since I am the one who is actually signing it?

also, If the me and my wife both are th emember of the LLC do we both need to sign all the leases or just one of us can sign?

@Peter Christensen you can terminate the lease with a written agreement with all parties. Then sign a new lease with just the girl with the terms you guys agree on. May be another 1 year lease or may be more or less, whatever you guys are good with. Before doing so, check is she financially qualifies your criteria. If she doesn't, get her parents to cosign the new lease. This is not complicated issue. Also, check you lease, you should have a termination clause. My lease says if all the parties agree the lease can be terminated on the terms accepted by the parties. Generally any contract can be terminated if all parties agree with it.

Is your current tenant paying actual market rent for your property? If he is, then the other person willing to pay $900 more sounds too good to be true. You need to be very thorough on details. Why is he willing to pay so much more than actual market rent. Do proper background check to make sure he/she is willing to pay not because no one else would rent him/her.

If your current tenant is paying around $900 less then current market rent, you definitely need to find a way to increase your rent. If that's the case of course any tenant will do some fixes themselves, knowing they could be paying so much more rent for a place similar to yours. And if that's the case you should give tenant advance notice to vacant and then rent your property with current market rent. Unless current tenant would pay $900 more rent.

Hello Bigger Pockets,

I have a few questions and I really appreciate your feedback. I understand there is not particular answers to my question in current situation. I wanted to know this in normal circumstances. 

1. What is the actual day I can charge late fees from tenant in Connecticut? From what I know CT gives 9 day grace period so I can charge late fees on the 10th?

2. What is the maximum late fees can be charged? I read $10 or 5% of the amount due which ever is less, I cant imagine 5% of any rent due can be below $10. I wonder if that is per day.

3. When can I serve the notice to quit? I need to give atleast 3 days for tenant to move out from the day of notice to quit, so can i serve the notice on the 7th of the month?

4. Now this one is related to the pandemic, If my tenant is not able to pay rent, can I ask for or are the suppose to provide any paper proof that they are facing job loss or reduction in hours ar work? How do I know if they are actually facning hardship from the pandemic?
