Actually tried this strategy, but I had to give it up, as every time I turned my back, the chimps kept running off to their typewriters.

It seems to me you may actually have two questions here:
1) Should I rent to this person in this situation? I would throw in with most of the others and say pass.
2) Is my property manager looking out for me the way I want him/her to?

Seems like a good deal, but you may want to buy it before he finds new tenants. He is lowering rents to get tenants in there that he isn't going to have to deal with - you get the honor of dealing with the low bidder.

Thank you all for you input.

I think everything is in order - I am using a lawyer, the petition to the court refers to tenant and all occupants. I emailed lawyer so he will be aware of what happened first thing Monday morning.

I mostly am just incredulous.

It is going. The process just takes awhile. It is frustrating - I am more comfortable acting than waiting.

So I am in the process of evicting a problem tenant. Lease expired and I don't want to renew, and he owes rent. Served him with a 3-day Pay-or-Quit. Sent petition to court and am now awaiting a hearing date. Today a U-haul shows up at the apartment. I think, "Great, he is leaving without an armed escort.!" But no! He begins unloading things and moving them into apartment. He has a new girlfriend. What is he thinking?

It cost me $500 for lawyer, plus expenses(sherriff's).

My first eviction was just served his 3-day pay or quit. To add another layer, he is my wife's brother. I am not happy about it, but I have tried many other things over the past five months including bribery but nothing worked. And though he does owe me alot of money, there are behavioral issues that are really pushing the action. Now the mom-in-law thinks I am the bad guy.

I am really looking forward to Christmas dinner!

As I was answering, Joel gave you other information that I also think is valuable. Basically, control the deal. Get a lock on it right away if you think it looks good, but make sure you have an out if your homework says, "No go."
