Hey @Karen Margrave

I crunched the numbers for the rentals on AirBnB. There are 151 listings on the site for the Costal Orange County Market. In this market are the cities of Aliso Viejo, Costa Mesa, Dana Point, Irvine, Laguna Beach, Laguna Hills, Laguna Niguel, Laguna Woods, Lake Forest, Mission Viejo, Newport Beach, Orange County, Rancho Santa Margarita, San Clemente, San Juan Capistrano, Santa Ana, Tustin. In San Clemente, there are 57 listings.

Across the entire Costal Orange County Market, the average listing is for $185 a night, The forecasted average occupancy rate for the next week is 37%. Correspondingly, the vacancy rate is 63%.

For the most part, you can look at airBnB to determine number of units and rent. Finding out vacancy is more work, as airBnB doesn't provide historical data.

My favorite blog about airBnB is from a host in Philadelphia. In her post Year-end Analysis she shares her 2012 and 2013 numbers. For 2013, she had a occupancy rate of 70%.

Very interesting situation you've found @Garrett.

While I'm not clear on the rules for Florida or Texas, but if you pass with real estate above a certain value, probate will need to be opened in the county the decedent(person who passed) was a resident.

The first step I would take would be to ask your lead if probate has been opened.

If that's not possible, see if probate has been filed in the county of the mailing address on the title. When probate opens, a notice is published in the newspapers.

Depending on the type of probate, you might need court confirmation of the sale.

Regarding eviction control in Oakland, CA, an owner can justly evict a tenant and occupy the unit provided that owner lives in the unit for a minimum of three years. There are other requirement as well, but the important one is the three year minimum.

This webpage does a good job explaining Oakland's specific eviction control laws when it comes to moving into a development.

Short term rentals, like what your tenants are engaging in on AirBnB, violate SF city hotel laws. Because of this, you can do a just cause eviction.

Before you start on a potentially costly eviction, you should send your tenants a letter asking them to stop with a copy of the listing you found on airBnB/VRBO.

If they don't stop the subletting on airBnB, then it would be time to have your attorney draft a 3 Day Notice to Quit (Illegal Use).
