Thank you Greg, the neighbore upstair has avoid 3 times in past 10 years to my ceiling, I really think is his responsibility that his radiator leaks.

should I just take the neighbore to court and not get HOA involved.

You need to have a professional repair the ceiling so you can bill for it. You generally can't bill for your time. 

Since neither will accept responsibility, you either need to force their hand or scare them. 

I'd send a letter to both the neighbor and the HOA informing them that on X day I will be filing suit naming both of them and we can let a judge decide which of them or if both are liable. Since this has happened multiple times, both sides should be prepared to bring documents showing what investigation and what corrective action they took (hint: they likely have none).

1) I don’t have insurance for this condo, because it building has master policy. And I don’t have mortgage so I didn’t buy insurance. 

2) hoa, tell me is upstair radiator who cause the leak and I should talk to upstair owner to have him fix that.

Upstair owner told me that the leak of their radiator is caused because building pumped too much heat. So building should repair my ceiling.

so now none of them want to take responsibility of those. and I don’t have insurance.

Do I have any other option beside taking upstair neighbore to the court?





Hi, is a condo that I owne, our ceiling is damaged by upstair unit radiator. 

HOA is involved and they reply to HOA request of fixing their radiator and reply to HOA email according to hoa, but when I write them to fix the damage of my ceiling they just do not reply to my email or txt or phone call.

And this is not first time that’s happening, in past 6 years there was two different damageme caused by them. They choose not reply and I just fixed myself is about $150 each time. But I am getting really annoyed by their attitude. What would you do in my shoes. Get attorney this time?

I am beyond frustrated at this point.

Yes I think at this point only way might be mirror to carry the lights in. If anyone has any good advice please let me know. Thank you
