Our properties are owned in TRUSTS.     Do we still  need an attorney?    If not, does the trustee need to appear, or can it be someone the Trustee assigns (like a manager)?   If I need an attorney, who is the "go to" eviction attorney for Warren County?

How did you guys do?   I also need an attorney who specializes in writing contracts for hard money lenders, as i'm starting to lend.

SDIRA experts chime in: So I'm looking to make a loan on a performing rental property owned in an LLC. It already has a first mortgage (at around 20% LTV), so a lot of equity. 75% of the $$ would come from my SD Roth IRA, 25% from my personal funds. (if you are an SDIRA expert I know you are going to ask if I could make the loan without the IRA...and the answer is yes. But tax free is better). WHAT IS THE BEST WAY TO STRUCTURE THIS LOAN? This is always a challenge in NJ because it's a judicial state and foreclosure can take many many months.    You can do seller financing in NJ, but it's just more risky, especially for the seller.      In some states, you could do a "land contract" aka "contract for deed" but I'm told they are not recognized in NJ at all, and you could have issues in court.    For the fellow looking for an RMLO, google "Call the Underwriter".   Tell the owner I said hello.

@Eric M. did you ever find a lender for that?     I have 60 k (valued) rentals with great cash flow, and find it nearly impossible to refi one at a time.  i useally have to bring a handful to a local bank, and do them all at once.

We would run a title search.     AND take title in a land trust.    I was mostly looking for problems that might be specific to NJ, as well as best practices in general.
