Definitely get a lien search done. We get a couple people a week that do it after only to find out the lien is still there or there were other liens or judgements.

@Wayne Brooks I don't think that's what we discussed, we discussed winning an hoa, filing quiet title and then the mortgage doesn't respond. Not a bank that didn't respond to the original LP. Like we discussed I'm not an abstractor that's why I hire them to do the abstracting and I just take care of business. I'll consult with my REO team and see what they say tomorrow.

we do about 100 lien searches a day for investors buying at the  county foreclosure auctions in Florida.  There are many deals to be had and yes a couple times a month we spot someone picking up a property for just Hoa or condo liens because the 1st mortgages didn't respond to the foreclosure notifications.  The bank can wine and huff and puff afterward, but they lose their lien.

You just tell them you have "equitable interest" in the property and if they don't like it they can walk.  If you have a good deal, investors won't care.

Usually the attorneys order it from a company (like ours) then double check everything and run down red flags and can give you legal advice on anything on the search.  Companies are cheaper because depending on what you order they cannot give legal advice.
