I would like to sell a rental property which has one tenant that a realtor who was managing for me, placed in there almost 2 years ago.

This tenant only pays $325.00 monthly which does nothing for me other than help pay the property tax.  This is a quadraplex out in Starke Florida which has one vacant rentable unit, while the other two need rehab. My current job as a truck driver takes up so much of my time that I no longer can commute to this property at my leisure, much less rehab or repair anything. The current tenant happens to be elderly, on disability and has had a recent surgery. She pays the rent on time so far, but I think If I can sell this property for a break even or a small loss, I could find me a cheap franchise to completely get away from rentals someday. This tenant is on a month to month agreement which hopefully benefits me here in Florida. My concern as mentioned to me by a realtor that I wanted to list under told me that the tenant has to sign the lockbox addendum. If I have no cooperation from this tenant will I be able to easily evict her to be able sell the property? Could I sell it to another investor if I could show proof she does so far pay the rent or did the realtor who managed the property really screw me over with this now concerning situation. 

     I have another rental which I am thinking about selling and the tenant who also pays fairly timely just told me today of this post: " There are soft spots all over the entire floor of the modular home they are renting. I just set an appointment with a Home inspector for next week to check the floor issue. If I have to for safety reason the modular home I will have condemned and sell it for whatever I can at a later date. Im Not caring too much about rental properties anymore since im stuck with my current emprisoning career.

As people can see this tenant has rattled me to where I have a snappy temper. My fear which I dont believe I have the answer is on a 30day to 30day rental agreement AKA Month to Month agreement is there a Statute of LIMITATIONS on evicting this tenant at a later date "when I have the money SAVED UP to hire a lawyer to evict him and the unauthorized roommate. Unfortuantly my wife quit her nursing job to go to Anetheist school which now Im paying for along with the Bizzilion dollars of other Bills! This tenant had violated the lease at the worst time when I seldom have much money. My thought was get a home inspection done and confirm that there are renovations that need to be done and steadily start raising the rent  once or twice annually up too that of market and too renovate the property which is all 1950s style tile, carpet etc.

I have read the Florida Landlord tenant laws to know that I personally am not breaking any laws! A lawyer or two have in their own "sneaky" ways have more or less hinted that some how Month to Month rental agreements are not legal and accused me of not paying Bed taxes, but my rental properties are not in the most favored sections on town and get renters with histories that are not very desirable. I would have been broke years ago have nothing to do with rentals ever from having to evict several former renters if they where on 12 terms vs month to month. My fear with the current tenant who has caused me so much grief acts like he has some entitlement and firmly believes his actions are defendable such as his allowing his gay lover to move into my property- no discrimination intended! The surrounding neighbors have all mentioned that this guy that moved in is not just a friend that is down on their luck etc. NO roommates allowed on my lease; but it is a month to month lease so I propbably have very little to fear as I can according too the law "provided I give the tenant 30 days notice and terminate the lease or evict if they refuse or just steadily increase the rents too the market rate  which is at least $100.00 more than what I am charging. Just yesterday I paid for a Professional Home Inspector to check out this rental and so there maybe be necessary renovations which clearly can not be any violation of any law on this planet for me to raise the rent to $100.00 immeditaly. There are fear mongers on this webpage and I can tell you that the threat of prison will not deter me from taking what ever action I feel is necessary!

This one tenant whom was my second ever tenant just happens to be a fledgling "Michael Keaton" deadbeat character from in  the movie "Pacific heights!" I have 2 options to pay the few thousand to evict him along with his authorized roommate or Jack his rent enough to see if he was Bluffing me, when he tole me if I ever raise his rents, that he would leave! My property is in need of rehab; but also in a pretty good enough area to warrant a $100.00 increase without repairs. The bottom line Is I probable have to kick this Bastard too the curb in any way shape or form and by principle with help from the law or he can leave by other means that i wont share.

I need to edit my BIO I must have been delusional when I wrote that, but also this one trouble making tenant has been the teacher of sorts on who not to rent too and he has made me way far stricter than when I idiotically accepted him. Every month he has been with me I have added more and more rules thanks to this S O B. One attorney told me years ago as long as the tenant pays you rent, who cares what they do. He has paid rent, though hardly ever on time, but his nonsense has taken a toll on me that I just cant deal with anymore. I have struggled with the thought of just raising the rent but just being aware of him sets off strong feelings of discomfort which I cant seem to let go.

My family have a history of hiring lawyers to do certain things  even a lawsuit against a contractor that burned a family member on a deal that costed several thousand dollars. I fear that these attorneys may cost way more than the $700. or so to evict. I believe I read on bigger pockets that some landlords offer tenants a few thousand dollars to move! I could struggle to get one thousand to evict the main tenant with hopes that his invitee roommate moves on his own. 

 As far as me being a landlord I never planned on going from one dumpy low income job to the next and so I rely heavily on my rentals as  I hoped would somehow help[ me to get ahead, but also all I can afford in a rental property are borderline basket case properties that already needed several thousand dollars in repairs. I may seem a little in the dark to be a landlord because I should not be one limke the countless millionaires on this website,  but I  need some way to make money to live. Honestly at times I wish I was dead but this is just a passing thing at times. I married a wife who wants to live in of all things an Fffff-ing MCMansion when I myself could survive comfortably in a shack or singlewide camper out in the wilderness far from mankind! rentals are the only thing that i have, the rentals own me and stole my life away from me long ago. I would be struggling for worse I think if I had no rentals and relied on the dumpy jobs of a trucker

Im kind of in the perfect storm were I feel like I have no control. I was supposed to be saving for taxes next year and this seems impossible. I fear I will have to sell a rental or two to crawl out of this mess if it starts to get worse. I am not religious but feel I must be some how cursed.

I have been for the last year and a half been paying all Bills to allow my wife to go through Anesthesia school. I am full dependent on all rents plus a full time job to pay for more than I could normally afford, plus I never planned on paying for every little thing that breaks, including a renters AC system that just happened to breakdown after 5 years of service amongst other nonsense that I never planned on occurring.
