Time it takes to evict a tenant on a M to M agreement in FL
Im facing my first potential eviction of a tenant who has near total disregard for my rental agreement. His most current violation is an unauthorized roommate that he moved in. He has threatened me that he has some sort of file on me after I told him I have a file in him. This renter here in Jacksonville Florida is on a month to month rental agreement. I am registered as an LLC which blocks me from evicting without a lawyer according to law. What cost am I looking at to evict this guy and how long can he drag this in court if he chooses to fight. He was forced to move from his last rental and I messed up by accepting this trouble maker. Lastly he threatened me that he would get the other tenant next door to move along with him if I raise the rent. Im sure he will refuse to pay any rental increase after being on my property for over several years with no rental increases.

@Kenneth Davis sorry for your deadbeat!!! Yes, get an attorney that specializes in Landlord Tenant law.
Did you first give him a notice to non renew? This requires a thirty day notice. I give my 30 day notice to vacate several ways, that way they cant say you didn't give it to him; post on the front door (take a picture with time and date stamp), mail by snail mail, mail certified, and lastly send via email with a read receipt. it's important that you do this now, so you can get him out by the end of August.
If at the end of August he does not vacate, then you would need to file for eviction. It normally takes about 45 days in Florida, and can cost about $600-$800 depending on your county, writ fees, sheriff fees, and if he contests the eviction. If it is bogus claims, the judge will clearly see that and enter for the writ and give you possession.
