There are a lot of extremely smart people that are also incredibly stupid. Intelligence is multi facted. You over simplify. 

If history has shown us anything- we think we know a lot more than we do and this is particularly true of those in power.

Labor market complacency is tough these days. Shortage of skilled labor and trades. Makes the job demoralizing somewhat.

Is he licensed? I'm not sure in NJ, but in Michigan you would be able to get him in a lot of trouble if you contacted the state licensing department.

Has anyone ever put together or seen a floorplan that pulls this off? Obviously 4th floor would need to be smaller than others. 30 ft limitation would be applied at the half way point of the 4th floor. Nothing could be below grade.
