First American has a pretty good reputation that should work well for you.

The HOA has the right to levy assessments but honestly whether it is wiped out or not depends on the documents filed of recorded in reference to the HOA assessments. When the subdivision is formed and these assessment are created they can be subordinate to the first lien mortgage or improvement liens or they may not be. I have seen them both ways. (I am a real estate tile examiner) You need to look over these documents to determine the subordination and the lien priory to make the determination who holds lien priority and which inferior liens are wiped out.

In my title experience contracts for deeds have really been pains for buyers I recommend against doing this.

Heirship issues such as this one can linger for a long time. I would move on until they resolve the situation if I were you. 

Every state is different but until you get the property under contract you do not actually have a deal I would get the property under contract with the applicable standard contract and make sure it is assignable then you need to contact a local title company/attorney to make sure you are following the right guidelines.

This is probably a reshuffling of the partnership it is actually fairly common if the title comes back clean from the title company then no need to worry.

I would get a local title company to run a title search on the property and determine what issues exist then you can go from there. If you go that route and figure out what the title issues are let me know and I can try to help you determine what the best way to proceed is.

Whoever pays for the title policy (usually the seller) generally picks the title company. A title company is a 3rd party unbiased party so as long as they are reputable you shouldn't have any issues.

Generally whoever pays for the title company chooses the title company although this is negotiable. 

And yes some local title companies can close anywhere in the US if they choose by partnering with other title companies. We do many out of state closings here in Austin for our clients. My advice would be to look up your local Fidelity or Stewart title company branch these companies are nationwide.

It sounds to me like the note getting foreclosed on only included the house plus 3 parcels. It is probable that when he acquired the house and 3 parcels that he took out one loan and when he acquired the other parcels he took out a NEW loan either with the same or a different bank. Thus the note being foreclosed would likely not be for both sets of parcels.
