"Cannot get clear Title"???
Hi BPers,
While searching the MLS for expired listings, I've come across a potentially good deal but it looks to be bank owned (foreclosed), which I use to avoid like the plague; However, I'm hearing more and more that these are sometimes good deals and even can be done in a double close.
My question is 2 part.
Firstly, Any suggestions on how to approach the bank/lender would be greatly appreciated. Someone suggested simply sending a Letter of Intent (LOI) to the bank and see what happens.
Secondly, in the notes of the expired listing it states that "cannot get clear title". Does this mean their is some sort of lien against the property? Does this generally disqualify a property?
If there is anyone experienced in this sector of REI, I would love to get your take on it!!

Great question Will,
IN some situations were title is all buggered up Heirs are long gone. parties never divorced.. estate was never probated because it just was not something the family new about or worried about.. title could be for ever clouded.. so the chance of someone coming back and making a claim is pretty slim to non.. but you have to pay cash get a great deal. and take on that small risk.. NO one else is going to buy it. and your not going to BRRR it unless you can get clear title.
NOw you can buy it and then quit the title.. and that can be a challenge and time consuming and costly and you never get it done. I have one in Charleston SC right now that we are almost 2 years into and 5k plus in attornies fee's for us its just cost of doing business If I never can get title or buy the prop well so what.. I lost 5 to 10k no biggee... and its a bare lot I want to build a home on and sell new construction.. so title insurance is a must if I am to do with it what I want.. can't rent a bare lot often.. this is very common in Charleston.. were you have very old titles and a lot of folks that just don't follow normal Paper work.. IE you hear.. well my mother left my daddy and the never got divorced and when he died they never probated the estate etc etc. these are the scenerios that bugger title it happens every where.. in all states and in all types of proeprites. those htat know how to fix them make a killing.. thank you Rick Harmon. !! the BP expert at this.
