it's best to cross check against FEMA map service center. If there is a conflict the MSC will control, provided the local floodplain manager hasn't obtained new flood data.

buy as an LLC that is owned by you and your buyer. Lastly you may use transactional funding if the costs don't eat too much of your spread.

Check with local zoning officials first. You can see what is legally allowed for development. Does the lot have sewer in place? If not your on site septic system requirements will limit your density. You may try rehab and split a half acre out to sell another lot.

the best way to really be done is to do the transaction legal and proper the first time. I would definitely at least use a title company. The closing could be done at their office so it might not feel so "formal" to the seller.

I would also serve the manager of the nearest local branch. If they fail to respond or show in court, you would be awarded a judgement which in itself I have found doesn't mean much. Where your leverage comes in is then filing an execution order whereby you could then go to say the nearest branch and confiscate 1400 dollars worth of their office equipment for liquidation. The check would get cut pretty quickly. I have to do this very thing for outstanding bills some of my customers don't pay. B of A had this situation happen at a branch in Florida. I saw it on the news and you can probably find it on YouTube. You should obviously follow your attorney's advice, but there are ways to get their attention. Good luck.

Hi Noel,

I don't feel you're  gonna see any real appreciation here for a long while. Things are finally starting to move a little but not like you need it to. If it were me, I would lease option it. If no one bit, I would just hold it. You're always gonna get a fresh crop of rotary guys coming in and you may be back in 10 years yourself. Be sure to factor in some expenditure money.

yes. Internet search or phone book should be adequate. Get two or three estimates and see who you feel most comfortable with. You may have an old copy in your purchase package when you acquired the property. If you do consult an attorney first, he or she may order a survey then. You have to know where boundary line is before determining who damaged who and to what extent. Survey first then attorney or vice versa I don't think matters because I think you'll need both. That us if you can't work out an agreement with neighbor beforehand. Since he used the word encroachment that is a signal that he feels damaged in some way.

A re-zone request is a formal procedure whereby a developer asks a local governing body the change a property's designed use to a new type of use. Usually simple but can get tricky depending on local politics and conditions. Talk to local zoning board first as you may not be allowed to do what you want to. Robert nailed it. Find out your best play before you go further.

I'm a land surveyor. We deal with these issues regularly. Get a current survey showing the original building and roof lines along with the new roof slopes. Also have them locate the down spout and gutter locations. Take this survey to a real estate attorney. Repeat. A real estate attorney. The gutter locations along with the common owner story may imply an easement or permissive use/  license situation that would affect the subsequent owners. Not a guarantee but maybe. You need to find out where you stand legally before you go any further. Your only guessing until then. I would suggest letting the adjoiner know that you're doing some research and hope to get some information that will allow you both to work together to find a common solution. It's always most expensive when the judge forces you to make it right.
