Post: CC&R Conflict with Zoning Ordinance

So I have gone through Biggerpockets and have not found this one....

I have a situation where CC&R's seem to conflict with local zoning ordinances. Situation as is below:

-CC&R's written in 1987 read "No building on any lot of said property shall be used for more than one single family dwelling and or accessory building".

- In 2015 zoning was legally changed to multi family.

My understanding of zoning vs CC&R is that CC&R's can be more restrictive, but cannot violate any laws. My understanding is that zoning ordinances are law, enforceable by such, and CC&R are voluntary agreements, a civil matter.

There is multifamily already permitted to build on the property and I know city planning and permitting departments are not privy to CC&R's. Would there be some crazy civil recourse on this being in conflict with CC&R's?

Curious is anyone has any insight or experience on this before I reach out to my attorney. Any insight is appreciated!

Allison James Estates and Homes. I hang with them. $595 per transaction regardless. And if you do more than 12 deals a year you can just pay a flat fee. AJ has the same "back up" and support as KW or Remax but without the hefty split. Check AJ out and if you are interested I can easily refer you.

P.s. I started using them specifically because of my personal fix and flips after two other brokerages.

 Thanks for the message. It's about finished. This has by far been the longest flip I have done. We had several weeks of delays due to the fact the house sits on a levee. Building the detached garage and getting things approved have been somewhat difficult. FYI, I have the home under contract of sale for just over $630,000. I hope to finish the garage so I can close and move on ASAP. I will have to be sure to post my final numbers.

Thank you! I did. I apologize for not keeping this post up to date. I was very happy with the price. To be completely fair for numbers sake, the home buyer was an active military pilot using a VA loan. I covered just under 11k in closing costs. Well worth it! Thanks for noticing and the post! I love it when a property sells as more confirmation to my initial numbers.

UPDATE!

So we are coming to a close on week 5. We are slightly ahead of schedule.  I have my Architect as structural engineer on permitting the garage to livable space and fixing a detached garage to the lot. A few week 5 pictures have been uploaded.

This was a short sale I've been dealing with for some time now. Found on MLS actually. I know know the listing agent though.

I do agree with you about being highest/best. The fact is there are to many comps. There is another, even closer, on surfside that is being rehabbed and will list for similar. Fortunately I'll be on par with FMV. This home has a open permit case for a conversion. And many other issues.

I use a program to create a floorplan myself. I will be vaulting a ceiling  (YES on par with comps and the roof is collapsed as is) and some other work I'll be in need of a professional.

I am currently underway on a flip and I am a few steps behind! I have a 2k square foot home that I need some work done for. I am going to be changing the layout significantly, buy am currently in need of a current floorplan. Then I will also need help with establishing purposed plans. Does anyone recommend a good architect / Draftsman or even an engineer that is in the Sacramento area with a quick turn around? Any help would be appreciated.
