All, I appreciate the feedback. I did hire a public adjuster and my policy does have a lost rental provision. The claim is in but we’re still waiting on the field adjuster to come out.

Hi, I’m a newish real estate investor and both or my SFH properties are located in Panama City, Florida. One property has half a roof and is probably a total loss and the other has bad roof damage and the sunroom was blown off. I’m getting ready to deal with the insurance claims process and was looking for any recommended reads or tips. Can lost rental income be recovered? Any other advice?
Nancy, Chris and Michael, thank you for the encouraging and helpful guidance! I’m absolutely emotional in this situation and especially because the law is on our side. My guy has put his rent in escrow through the court. He’s considering using the SCRA along with his orders to break the lease. His “whiny” wife got sick of living in a sweat box and he paid $900 to fly his wife and kids back to stay with family until this situation is resolved. Y’all will get a kick out of this. The landlord offered to bring by and “install” portable AC units. He left two small box fans on their front porch 😀 it is sad yet comical. Although I’m sure some will say the tenants should be grateful and cool their 2700 sq Ft, $1800 per month house with those. Bottom line, this LL is breaking the law. Whether the tenants are millennials or military is irrelevant in this case. I didn’t even mention the fact the landlord yelled at the wife in front of her children because he is upset the AC broke. There are too many other points to even get into. I don’t think it will come down to court proceedings outside of the rent in escrow. I advised my guy to use the SCRA to break his lease and move on. I don’t wish people ill but this LL should obey the law or get out of the business. I’ll do everything in my (limited) power to ensure military families don’t rent from him in Ohio or anywhere else he owns property. If he continues to break the law he will get sued sooner rather than later. Best of luck to him in finding his consciousness and guiding light.
Glad to be labeled a millennial though I’m not. I come from a generation where we do the right thing. I cannot see how a five week repair on an AC unit is reasonable and unless I’m missing something, Ohio law is pretty clear that this problem should be addressed within a reasonable period of time. I cannot see why the landlord wouldn’t put in a portable unit with his money and then take it out once the problem is resolved. I apologize for getting emotional because my guy is here next to me in some of the most inhospitable conditions in the world and he has to worry because his wife and kids have to go sit in their car with the AC on because their rental home is an oven and their LL is being accusatory and unwilling to meet them halfway.
Anthony, I pray you stay out of investment real estate if that is going to be your mindset. Military families make huge sacrifices so all Americans can enjoy the comforts of life...my Guy was given 10 days notice before he had to leave his family for 9 months! The actions of this landlord are shameful and, according to Ohio law, illegal. I didn’t mention that the landlord is trying to make them pay for the repair because they didn’t change to air filter every 2-3 months even though the lease doesn’t have specific requirements for frequency but just “as needed.” This guy owns multiple DIY flips in the Cleveland area and from the sounds of it is a cheapskate looking to make a buck without providing a decent service. They have had many other issues beyond what I’ve mentioned! Man I’m fired up...this LL is fortunate I’m on the other side of the globe...taking advantage of mil families, them is fighting words (verbal fight tho...I like not being in jail)!
Thank you everyone for the inputs. I would definitely hardly consider asking for an AC unit to be fixed in a rental where it was working in a timely manner to be whining when it’s approaching 90+ degrees in Ohio. If he wanted his family to not have AC then I think he’d have prob rented a place that doesn’t have AC. I think this landlord is taking advantage of the fact that my guy is half way across the world and it’s shameful that he won’t put in a portable unit while they wait for repairs. My guy understands the repair timeline and is hardly asking for a miracle or for the landlord to bend over backwards. If you are a sh!tty person you prob shouldn’t be a landlord. My guy also signed a three year lease so he is kind of trapped unless he wants to go to court to break his lease. I suppose he could use his deployment orders to break the lease.
I pulled this off the Ohio Landlord Tenant laws...State Code 5321.04 Landlord Obligations Section 4 "Maintain in good and safe working order and condition all electrical, plumbing, sanitary, heating, ventilating, and air conditioning fixtures and appliances, and elevators, supplied or required to be supplied by the landlord"
Thanks Chris, he may just have to spend the $200

Hello, I'm active duty military deployed overseas. One of my guys is having huge problems with his landlord in Ohio. The AC has been out for two weeks and the landlord is saying it'll be two to three more weeks until the part gets in and the AC is fixed. Meanwhile, my guy's wife and two young children are stuck in a scorching house! The landlord also refuses to provide portable AC units or pay for a hotel until the unit is fixed! What are their rights in this situation? Can they get reimbursed if they buy portable units themselves or go to a hotel? Can they stop paying rent? Any other advice? His wife has an appointment wife a RE attorney on Tuesday. Any help would be greatly appreciated...it's kind of hard to get involved from the Middle East! This landlord should be ashamed!
