I purchase HOA's foreclosures (liens) all the time. The HELOC is recorded prior to the filing of the lien by the HOA .... it will survive the foreclosure sale (in Florida & California for sure). You can try a Quite Title or Declaratory Action via a license atty .. it does work if you can locate flaws in the title or transfers. Other than than try negotiating with the HELOC. I just completed a settlement that had a 79K HELOC for 15K. Just do your homework!

Yuliany, I can only speak for California contracts as this where I primarily do business. I find this clause in the vast majority of business contracts. It is inserted in the contract in part to stop frivolous lawsuits. If you know in advance that if you loose you will have to pay the other persons atty fee's... I can tell you from personal experiance .. you will think very hard prior to filing... That is the reason... Hope this helps.

Hello Everyone...

I purchased a MFR (Quad) located in Alabama. I use Affinity Group (nreinsurance.com) for all of my SFR flips around the country. They do provide MFR insurance but I was wondering if anyone had any other suggestions for insurance on this property. Thanks in advance for the help.......
