Last year I had a tenant apply for a two-year lease on one of my rentals. She had really good income. Single mother with three kids. One year into the lease, she informs me she's been approved for Section 8 with a voucher that is about $600 higher than the cost of her rent. I certainly don't mind HOC, however it will be the first time renting to someone on HOC. I'd like to get advice from folks on here the best way to handle the situation. Do I have to re-do her lease? What requirements and or things should I be aware of as I try to determine how to sign up with HOC to receive rent from them for her. Any advice?

@Amanda Chandler The agent did a background check with their previous landlord. I can ask him to check on that. I just want to make sure I'm taking the right course of action on this one.

@JD Martin I'm not sure what would happen. Whatever she brings up, I can always state that her application stated that a. she was not under the housing program, 2. based on her income reported and number of people on the lease she does not qualify, 3. even if she was not on the program when she completed the application, the program is not accepting new applications.

@Marc Winter What's your advice? I could, 1.  call her out and terminate the lease (that could be headache) or 2. demand that I see the full form filled an signed by her before completing my portion. Option 2 is what I'm leaning towards. I haven't had her in the property very long to know her consistency of payment and ability to keep the property clean. She had 800 credit scores, but certainly she's pulling a fast one.

@Victor Buquer - Unfortunately she's on lease and occupied the property three weeks ago. I fully agree and am not comfortable filling out Section 4 w/o knowing any information in the previous sections. Additionally, my thought as well, everything should already be on the application as well as the lease.

I have a tenant who applied for a property. On her rental application she marked "No" to the checkbox asking if she's on rental assistance. We moved forward and accepted her application. A week after moving into the property, she sends  Section 4 of a rental assistance form to complete stating she resides in the property. I do not want to make any judgments, however 1. The income she reported on the form with the number of people in the property does not make her eligible, 2. The program is currently closed, which leads me to believe she was already on the program. I asked her to fill out the complete form and send me the full form so I can complete the landlord portion and keep a copy for my records. She rudely stated she has private information on the form and needs just section 4 completed. 

Question: Should I complete just the section 4 of the form, w/o seeing the rest of the application and that's completed in it or do I have rights to request to complete the form only after seeing the complete filled out form.

Is everyone applying here have and LLC set up do you have to have an entity setup to qualify?

I have four properties and self manage them all. I never set up true entity do I qualify to apply as a landlord?

Amidst this COVID I’m trying to assess how many people have rentals active on the market and whether you’re seeing a drastic decrease in rental interest/applications. I have a bank accepted foreclosure. After rehab, which I estimate will take about month and hit the market in June. It’s my first rental I plan to actively market to section 8. Property is located in a C+/B neighborhood. That said let me know if you’re seeing a drastic decrease in rental interest.

@Larry Alexander - I believe she will return the money, however my advice to her would be if she believes or arrives in believing that she's truly in the right- she'll have the choice to keep or return the money. My general advice to her has always been to stick with what is in the contract. She generally tries to be nice, but I've read enough stories in this forum to know that "nice" can sometimes get you in legal trouble. But good point on the cost of actually collecting $500. I believe this is just a scare tactic.
