we rent to a lot of grad student college kids who are pretty busy who don't really mix well with the couple

Thanks @Matt Geerts interesting.....

i've gotten feedback to let the tenants handle it, but i guess i've always liked to try to keep it a good living environment and make sure it's all good....

what would you do?

Compromise is what I'm leaning to... which sounds like what every one else suggests or evict.

He's been a good tenant himself, but asking for the wife to stay over more and more frequently I feel is over-extending to the other roommates, who don't like it. She isn't employed and studying overseas from Ireland so she's at the home all day.

@Michael Henry I have to disagree, that interpretation of "understandable" is subjective to me. Because it can very well be interpreted (and is, in this case) as unconventional for the married couple to share a home. 

If he PLANNED to have another authorized occupant then he could have added her accordingly rather than spontaneously making it everyone else's burden....

Either way, it's not clear what is absolutely binding.....

So compromise, I think it's best option, to let her stay for the month that he's requesting the last time since she's planned to come already.... and make sure it's not okay anymore. If he does again, I'll pursue failure to comply, because she's NOT an authorized occupant.

@Missy H. I know there's occupancy laws in DC that state it's 2.5 people per room in a home.

But I can't understand that law would permit any "immediate" family members to move-in over the leases authorized occupant list. In circumstances like renting to a pregnant woman is understandable. But renting to John Doe, who decides to get married and adopt 5 children in a month WITHOUT having their names on the lease doesn't make sense.

@Mike Dymski I definitely agree, but not sure of legality in charging higher rent to couples as opposed to singles......

I use the Maryland Association of Realtors lease, it's not stated anywhere specifying a cap for guests and I don't remember it being stated in their lease.

@joseph I like the suggestion. Do you mean just increasing rent?

Unfortunately I believe it's illegal to just charge more if there's another occupant there....

@frank because the roommates don't want her on the lease.

Are there laws or rules against a tenant's over-extended stay?

one of the tenants just got married. 

of course before he signed the lease he assured she would come here and he would go there.

and of course, it's just been the wife coming to stay longer and more frequently.....

No specific addendum we wrote to cap this is in our lease.

Tenant is requesting a month now for wife to stay during holidays and it's a nuisance to already complaining roommates.

Feedback appreciated.

I don't know the CA laws, so this is just feedback on preventative measures.

First send out lease renewal 2 months in advance. They never get back timely fashion, so send a few reminders. And as you know, they may very well not do what they say, so don't make plans until ink dries. 

After first 30 days, then make plans for the alternative of them leaving or evicting. Deliver non-renewal and notice to vacate.

In the last 30 days prepare to clean, market and show to minimize vacancy.

Leaves you as much in control as possible

Yup, that's what I meant by 'transaction agent' in not representing the buyer. Only making sure paperwork is served and delivered
