I'm a investor here in Lubbock. If this was my problem I would consider what my fastest and cheapest way to get cash back into my pocket would be. I don't see hiring a attorney being in the win column. I don't see spending money on new flooring and a new fence being in the win column either. If this were mine and I like the cash flow but don't have a firm grasp on property management I would pay a house cleaning service a $100 bucks or so to clean it from top to bottom, get a handyman to fix any small minor repairs $500 at most typically, and then I would sell the house as is for full market value (10% over market value if you decide to fix all damages and repaint). How do you sell? Owner finance it to your tenant buyer with 10% down 10% interest for 10 years to 30 years depending on what the tenant buyer can afford to pay monthly. I'd make sure that the payment is at least what market rents are or slightly higher. So now you have 4 to 5 digits cash in your pocket that's your money not a deposit that you have to hold. You have the same or better in monthly cash flow. And your not responsible for any repairs at all. They are home buyers and pay for taxes and insurance which can be escrowed in with the payment.
