HI Joe, thanks for your reply. The property is titled in an LLC and the relative was a member of the LLC at the time of the transfer. A number of years later, she consented to be removed from the LLC and we had an attorney draft up the agreement. The loan remained in her name since the property was purchased and even after she was removed from the LLC. We plan to keep the property. Been in communication with the mortgagor and even after submitting the trust doc, they say it's insufficient and want a grant deed, quit claim or probate document. Do you think if the grant deed showing the transfer from the personal name to the LLC would work?

Hi,

What happens in the case where a relative passes away and the mortgage is under her name, but the title of the property is under an LLC that she is not a member of? The relative had a living trust and will granting family control should anything happen to her.

We notified the mortgage company and they won't accept the trust documents as valid proof of ownership and are demanding that we get a probate document, a quitclaim or grant deed showing the title granting out. 

What are our options without having to go thru probate?

Can we deduct from security deposit damages not yet repaired but nonetheless were damaged by the vacating tenant? How would we calculate the damage?

Specifically, countertop that was greyed out by something they did

I'm reading contradicting info on rent increases for a property that's NOT in a rent controlled area.

If increasing rent less than 10%, do we need a 30 day or 60 day notice for tenants who have been there over 1 year? 

Would it matter if we're doing a new lease versus leaving it month to month?

Hello, Is anyone else experiencing the outrageous almost 4x cost in the landlord's homeowner's fire insurance? The insurance companies are saying it's affecting all of Florida? What's causing it? Property insurance is now about as much as property taxes!

For the fence, she was given advance notice multiple times in writing by text as well as verbally and she even said she would leave the gate accessible. She was in the house at the time, so it wasn't like she would be greatly inconvenienced to open the gate.

Hello, got a tenant who has an attitude where she thinks she's the boss who does whatever she wants. When asked to do something like opening her yard so contractors can come in, she argues back and says to tell them to just jump over the fence even though she's able to unlock it for them. We had some old  wood pieces that had been left in her yard when she first moved in, so we told her two years later when we remembered them that she can dispose them if she doesn't want them there. Her yard is a few steps away from the trash bin and she replies that we need to remove them ourselves. What's the best way to handle this situation with an uncooperative tenant who is not pleasant to interact with? She's on a month to month lease.

Hello. What's the best way to handle a situation where a tenant keeps a very dirty backyard and she has said she would clean it up but still hasn't taken any action?

What happens in the case for a CA rental where the tenant signed a one year lease and then a few months later, broke the lease and moved out without giving a written 30 day notice (we only found out when another landlord called to verify prior rental history).  She saId that there was a guy who came to her unit and pressured her roommate to go out with him, so for safety reasons she didn't want to live there anymore. 

She refused to pay rent on this unit, stating that her security deposit can be used to cover any unpaid rents. From my understanding, she is required to pay rent till we find a replacement tenant and she cannot say to use the security deposit because we don't know how long it will take to find a replacement and those funds are reserved for damages.

What are our rights in this situation?

What's your take on how to handle a situation where a tenant has a guest visitor who will be staying for a week and the visitor has a dog she wants to bring along during her stay. Do you charge anything for the visitor? Do you allow the pet or require a pet deposit? What's the best way to handle?
