Hello All,
exec order 128 nj signed by phil murphy allows tenants to use security deposit as rent. The order makes a vague reference that it was created to prevent financial hardship from covid. However, the order does not state that the tenant has to prove financial hardship. The exec order does not explicitly place any income limits.
My tenant in NJ- gave me a notice that they would like to use security deposit as rent . The lease expires in 2 months.
I know that the tenant has a good job and not in financial hardship. They pay rent on time. I am worried that If I use up the security deposit and find damages at move out-- it places the burden of pursuing for damages on me rather than the tenant.
I contacted a real estate attorney and they said there is not much I can do about it as the exec order does not require the tenant to prove financial hardship.
Are there any suggestions on how to deal with this.

Haven't heard about partial lean waivers. Will have to look into that for future.
The work that he did complete was amateurish and botched up , as it basically needs to be redone. Ill have to hire another one who will basically have to redo the work. I should be disputing the amount that was already paid, but its not worth my time to pursue that.

Be sure to leave reviews online. I have personally been threatened with "the attorney general" a few times and it means zip. Online reviews are what will actually keep people away in the future.
I have no idea why home improvement general contractors all seem to be ridiculous. Specific trades seem to be fine, but you get the general type and its always some kind of semi-scammy nincompoopery.
This has been my observation too. the specific trade contractors were great- competent, finished work on time.
Judging by the (lack of)quality of his work and the way he abandoned work completely- he probably does'nt care about online reviews either. But you're right, It would keep unsuspecting customers away.
Good thing is there are plenty of contractors in Harrisburg, PA looking for work. Hope It will be a better experience next time around.

I have pictures/ videos/ texts / emails documenting his incompetence. Will consider reporting to PA attorney general to help future investors away from this dimwit.

Hello,
I'm in the process of first rental property rehab, so far iv been lucky to find great contractors at the property, except for one bad apple.
Hired a licensed, insured contractor (HIC license)for rental property rehab.
. Made 50 %dpt. After finishing 50 %work, he has disappeared for a week , not answering calls and now refuses to work. Contract completion date was 2.29 and work is far from done as of 3.10. Debris lying everywhrere in house. He breached both written and verbal time agreements.I also gave him a chance to correct his errors yesterday and finish work but he refuses to do so.
(I'm not sure why he's doing his?. Probably he got mad because I called and yelled at him for not showing up to work for a week.)
Contract exerpt
"
B. Owner's Termination. Owner may, on fifteen (15) days’ notice to Contractor, terminate this Agreement before the completion of the Work, and without prejudice to any other remedy Owner may have when Contractor defaults in the performance of any provision of this Agreement, or fails to carry out performance of the Work in accordance with the provisions of the Contract Documents. If the unpaid balance on the Contract Price at the time of the termination exceeds the expense of finishing the Work, Owner shall pay such excess to Contractor."
1. Can I legally fire him for material breach of contract.
2. I don't think I owe him any more money as he breached he contract. Thr cost to finish work will exceed his unpaid balance
3. Can he still file a mechanics lean?
any other options?

Yup that didnt make sense to me. They're basically saying no umbrella for older than 1978 properties.
Not sure who will go through expensive lead abatement process just to get an umbrella with them.
(When even the primary homeowners is ok with it)

Hello,
my rental property was built in 1960.
I got the standard lead disclosure form that says seller has 'no knowledge' of lead based hazards in the property.
I tried getting umbrella insurance from Geico.
Geico is saying that the seller lead disclosure form is not enough.
They need an actual lead free certificate from a certified lead inspector.
Since, properties before 1978 are almost certain to have lead based paint, is this geico's way of saying we won't give umbrella insurance to properties older than 1978( unless lead is completely removed)
interestingly, the primary homeowners insurance policy on this property didnt have any lead based issues, but the umbrella insurance company does!
has this been your experience also?
Is this what other umbrella insurance companies ask for as well?

You can use it to offset w2 , only if ur a real estate professional and ur MAGI is less than 100k
If not, you can carry forward this loss to future years where you can use it to offset future rental income ("passive") positive cash flow.
