I have been accepting rent checks at my credit union into my account for the past several years and it has worked out well untill I got a tenant that needed evicted and he put the rent kin knowing it would bounce with nsf - long story and I will address it at a further date.  I might have to switch that they will be cash depositis for all to avoid another nsf check.  He is habitual and I might loose $4k on this eviction because he is being warranted for a felony - he is a habitual offinder and I would love to see them both stopped in their track,  Time will tell and I will inform all of the direction this has taken.  The police department is putting out a fraud warrant for his arrest as he has quite a history.  I do not know if I have a chance to be paid treble in the end - it would be nice.

To update: on the day I received a judgement for the eviction, I decided the timing was good to take the check to the police station to make a fraud report on the NSF check I received from tenants friend for her rent.  At first they believed it was a civil case untill I explained the 4 reasons why it is a fraud case which needed to be persued.  They agreed and took the case - they have had the case a week now and I get a call from the detective for the secondtime, and this time he is telling me that the person who wrote the check is coming into the police station next week to pay the $1075 check,  The officer said sometimes the threat of a warrant and 90 days in jail along with a ticket, sometimes changes their minds.  I have heard the promises for weeks but I certainly hope this is true.  This will offset some of my losses so far but I still have to sue in small claims court for the rest that is owed - bad part is I have no present address for the tenant since she moved a few days ago.  Is this important at this time or no???

On May 8th I received a judgement for posession - they now have 10 days before the bailiff will physically evict them if necessary - I have also filed a police report - I will update as I know - any info sure would help.

I am going through my first eviction case ( court tomorrow) and I certainly hope the last.  of course I will send the other tenants a reminder - in the form of a Notice To Quit - they ( every properties Notice To Quit) have all been printed and other then dated, they are ready to go - I will never wait again no matted what the reason - get the clock ticking immediately - regardless - for me it will be 30 days from the Notice to Quit before the bailiff puts them out - I could hafve started this 12 days sooner - that delay will never happen again.  I can only hope they leave on their own.  I can only hope.

I use to have grace days- but tenants were paying all the time on the last grace day - not using it for the purpose intended but as a new date due, so new leases are being written and there will be no grace period - the rent is due on the due date, Period.  As for late fees, I am being told by local attorneys that our judges in Michigan do not like to see more then $50 in late fees per month.  I don't agree, but I will make the adjustment. 

We are in the process of going through our first eviction case right now.  Mostly because I didn't hold up to my set of standards in tenants screening.  This has been a costly learning experience.  But I now have a Notice To Quit printed except for the date, for all of my properties, and ready to go on the day after a late.  Being burnt makes you change your ways. This is a business, strictly a business, no emotions... soon - I am still in training after 7 years. But as long as I do not repeat any mistakes, it will be okay.

Yesterday I did a dry run at the courthouse on the day for eviction cases - I was suprised to learn that 90% do not even show up to court.  I will change the way I did this one too.

It is a felony when either over $500 or you can prove intent to fraud - with never having enough funds in account is enough.  I have started the 7 day - meeting with attny today - the check might be a seperate issue I do believe. Thank you

The person that deposited the check is not a tenant and it was a starter check - we do not have a name and bank does not want to disclose this - I need this information to press charges at police dept and follow with suit in court system- feel like I am caught in the middle

This will be my first time aswell after 7 years of rentals.  I am using an  eviction attorney this time - the price of learning what to do. I never saw this coming at all - I need to regroup with my tenant screening skills as I let my heart get in the way.  Trying to do a good deed for someone and I wind up footing the bill - shame on me - I guarantee it will NOT happen again - in the interim I hope to learn as much as I can.  Any addition info would be greatly appreciated
