Thanks for the replies. They have been in the house for 2 years, late every month but they paid the court and late fees on top of the rent every month until this last month. There are problems in the house in which they asked me to fix but i told them they were responsible since they were buying the house. They were late as usual and I was going to accept the late payment but they sent me an email stating they would pay what they owe but they would put it in an escrow account until the repairs were made. They called the Board of Health and since its not their house yet I had to respond. So I just decided to not accept the payment and proceed with the eviction. We go to court next week for the damages hearing and I am thinking they are going to counter sue because in the contract I did state that the payment included maintenance insurance and admin fees and also that insurance covers damages to the house. I also sent them a text stating that I was their mortgage company and they were responsible for repairs. Help first deal gone horribly wrong.

Hello everyone I just have a quick question. I am in Indianapolis and this may be a question for a local Real Estate Attorney, but when doing a land contact where I am basically the Mortgage Company for someone, when they default do I file foreclosure or take them to eviction court. Or is both an option? Any help is great... thanks

Thank you so much @Brionne Moss and @Steve Vaughan for the positive feedback. I will definitely look at all the recommend links. I will also reach out to Ryan D as well. I will find a solution for this homeowner rather its me or a fellow investor. It's a great learning opportunity and I'm not passing it up. Who knows the odds might just be in my favor. @Steve Vaughan I really appreciate the words to remember that helps alot.

@Rob Beland Thanks for your reply. I figured as much that's why I never got started because I don't have any money and don't know what else to do to get started in Real Estate which is something I've been wanting to do just to scared to step out with nothing. I would try to wholesale it but I don't have contracts to even lock it up. Guess I will figure out something like seller financing or something.

Hello BP. I think I finally got this together. I started out looking for properties for my uncle that lives in another state. I Drove thru the neighborhoods that he was interested in but really didn't know what to do after that so needless to say he had a friend here that is going to sell him their house. I did network with a local investor that sells properties and been forwarding them over to him. But anyway the real reason I'm posting is because I have my first appointment set with a sell. So after things didn't work out with my uncle I said enough is enough and its time to start marketing for myself. I am broke and can't afford the professional looking bandit signs so I said you know what I can make them. I didn't want to put them on light pole on corners because I know the city comes around eventually and takes them down. So I figured I drive a bright green little spark and a lot of people notice it because of the color and its little. So I took my last 2 dollars and brought two lime green posters. I was going to buy sticker letter to make it look neat but it was more than I had so I grabbed my sharpie and wrote we buy houses on it. I cut 3 squares and put 1 on each window of the backseat and 1 in the back window. I have a free google voice number as well. So yesterday I got a call from a couple that saw my green sign in my car and they have rental properties and one of them they wanted to sell. I was so excited because it actually worked. So I set the appointment for Saturday. I was nervous talking to them I think I rushed thru it but I got it set. So now whats next. I have no money no credit no buyers no paperwork nothing. So I'm in what if mode. What if I can do something with the property then what. What if they let me put it under contract then what I have no contracts. Am I moving to fast? Should I have these things in place first? That's part of the reason why I never made a move because I didn't have any of these things in place. I was just tired of saying I was going to get out there and never did. So any advice would be GREATLY appreciated.

Hello BP!

I have recently been driving for dollars in the Indy area and I have come across ALOT of vacant distressed properties. I have done the research that I know how to do in finding the owner but that's were it ends. My question is should I call only the FSBO and for rents, or the ones for sale with a company also and just start putting in offers even tho I cannot qualify for a conventional loan. Just wanted to get multiple opinions on this because I am ready to get that first deal under my belt! Thanks all

@Steve Vaughan thank you so much for your response. I think I may go with the bird-dog just until I gain a little more experience. The investor is my uncle so I'm sure we can work out something that is a win for everyone involved. @Charles Socci I am working on obtaining a license, I let my expire, but I think as long as I'm not representing anyone I am not breaking any laws but I will be sure to double check. Good day everyone,

 I am finally going to get my feet wet in the real estate world. I have an investor that wants to invest in my area but lives in another state. He gave me his criteria and I told him that I would look around for him I guess birddog. So my question is if I find a property that meets his criteria should I go ahead and get it under contract (which I Know nothing about) or should I just give him the numbers and take pics for him, by the way I am not a Realtor. Any help is GREATLY appreciated. Thank you!!
