They don't...typically. A lender isn't going to let go of the original guarantor unless the replacement guarantor puts the lender in a better position. That said, if the replacement borrower is stronger, the lender might be open to an assumption. it is as you say, a case by case thing.

Investors in residential space are not known to assume loans. They are known to take a property subject to but that is not an assumption in spite of popular opinion to the contrary.

You may have a recourse, if you have a OHIO Realtor/Agent License you could reach out to your the MLS Board, they typically have a lawyer on retainer. Reach out to your MLS Board anyways your city/township belongs to, they may help you.

This news is interesting given that the Pheonix market is super hot. We can only articulate Why? #Zillow has decided to dump its home inventory in this MSA. The following are a few that comes to mind:

(1) Holding cost/s to fix these properties far outweigh the profit the company was going to make after rehab.

(2) The turnaround time to fix these properties is untenable due to the shortage of labor costs.

(3) The inflated acquisition price, coupled with an extensive long lead time of raw material have exasperated the new supply of new housing inventory.

(4) Institutional investors are selling/bailing because of the sentiment of https://tinyurl.com/Shoeshineboyindicator.

(5) And last but not least, the AI algorithm has taken into account the above parameters and predicted a bearish outlook for the subject housing market segment.

With all of the above in play, what? is the average person/investor to do:

(a) first not participate in speculation of prices and (b) brace for stagflation-that comes with a price correction of the housing market/s and the debt market in the coming mid-term time frame. #realestate #financeandeconomy #ai #housing, @Business Insider

So What? are the ramifications of the eviction, the local city/State could still ban evictions, Boston Mayor did just that.

1. Will the evictions process clog the court's system? - Very likely, because everything and everyone is working remotely

2. Will the Landlords be made whole again? How? can they recoup the rents due to them, very likely by the Stimulus bill.

3. Those renters who bailed without paying rent will likely declare bankruptcy.

In the final analysis, the victims are small mom/pop landlords and MF Cos. who will have to liquidate the Real Estate assets to protect themselves from bleeding furthering the crisis of liquidity in that Real Estate Class. It's really tragic the unintended consequences of the eviction ban has caused a lot of chaos for both the renters and the landlords.

@Jeff S. I Appreciate your time in responding to my post as well as elaborating on your explanation.

I have additional follow-up questions if I may, If I'm funding a flip my equity share $ 50 K (Rehab) would be approx 27 % of the Project. Whereas the equity of the GC is $ 180K, ie., 78 %. I don't understand how? the 50-50 JV work in this scenario. Pl. explain
