Wholesaling with an agent present

Greetings Wholesalers, I am attempting to get a property under contract from a probate lead. When I first made contact with the son I told him " want to buy the house in cash" and he replied "ok cash is king" A week later he notifies me that he has an agent who going to take care and sell the property and is in contact with the estate attorney. I asked if he still wants to do an off market deal/cash deal and he said yes. If my cash offer isn't accepted the seller wants to list the property (for 2 million) My question is will I still be able to get this house under contract and be able to assign the contract to someone else although I am dealing with his agent? Any insight would be helpful.
