Last thing I need to know before I get my first deal under cntract

I have been working with a seller who has a mortgage on their house that they want to sell. The question that I have is how to "structure" the deal. I don't want my buyer to take over the mortgage but if that's how the deal has to be done then I will set it up that way. The mortgage is around 18,000 and he accepted a offer of 21,000. The ARV is 40,000. When the deal goes thru will 18,000 pay off the mortgage and the seller receives 3,000? Or does the seller receive 21,000 and the buyer has to take over the mortgage payments? The second option is what I am NOT trying to do for obvious reasons. Suggestions and help PLEASE!
