As the seller can I cancel a contract

Sheri Rolfe
Posted

Good morning

We have had an extenuating family circumstance and I need to cancel the sale of my property in Charlotte.

This is a FSBO and I agreed to pay a portion of the buyers commission.

I have already accepted an offer and recently notified the sellers agent of my intention.

Am I legally able to cancel the sale?

Thank you!

I'm not a lawyer, and I'm not in your state, so take this with a grain of salt but-

If "accepted an offer" means that you signed a legally binding contract that doesn't provide you with an out, then the short answer is no, you cannot legally cancel the sale.

What you've got to figure out is if the buyer is going to pursue legal action against you if you cancel the sale. And is it worth it to put up a fight if the buyer does.
