Can I no-cause evict a section 8 tenant who is on a month to month lease?

Hello Everyone,

I am in the process of purchasing my first home. The home is a duplex with both sides rented to section 8 tenants that have been there for 2+ years. To be in compliance with the loan, and to get out of my in-laws, I need to be in the home within 60 days of closing, which means one of the tenants has to go. For reasons unknown, the current owner will not evict them. Vermont allows no-cause evictions, but according to my closing lawyer there is a law that says that section 8 tenants cannot be evicted without cause, and cause would be failure to pay or breaking of the lease agreements. According to the seller both tenants have paid on time and have not broken any of the lease agreements, but are month to month.

I have not been able to find any law that says section 8 tenants cannot be kicked out for no cause, and I asked the lawyer to provide that information, but he has not gotten back to me yet (I just asked). I am still within my inspection contingency, so I do have an out at this point, but this home is perfect for me, so I would hate to give it up without doing my due diligence.

In the end best case is the tenants leave within the 60 day notice they are given, but my lawyer says if they want to stay that it is well within their right and they don't have to leave if they don't want to.
