Eviction letter, late rent
Hello peeps, my renter has not paid September rent yet(due Sept 25), October rent is due in 2 days, I sent them first notice regarding Sept rent being 28 days late. How soon should I give them eviction letter? Is there like a legal format for eviction letter? Hopefully they pay this week for 2 months rent...
also, I mailed them addendum for lease agreement that rent should not be late more than 10 days, is this legal? thank y'all

Why is the Tenant paying rent after the month is over? Rent is normally paid in advance.
You should have started the eviction for non-payment of September rent. Don't ever wait a month for rent! If your lease doesn't stipulate when rent is considered "late" then go by Texas law which states you have to give them a three-day grace period. Then you can file the 3-day Notice to Pay or Quit on the 29th day of the month, four days after payment is late.
