Unpaid rent / follow up

I have a tenant who hasn’t payed rent since March ,Been 5 month without pay .My attorney started eviction process ,Tenant was surprise he was served with legal paper ..I mean what was I suppose to do ? .. this was two weeks ago . Haven’t herd from my tenant every since . Today I drove to the property to take out the garbage and notice a Uhaul truck , tenants are moving out without any notice , ? Are you kidding me . I don’t want this tenant taking advantage of their future landlord, since he hasn’t been to court yet && it won’t reflect on credit . What would you guys do in this case ? Would you take him to small claims court ? Located in NY .

@Tony Merchan  Talk to your lawyer as he might be able to put it on his record.  Also get in writing that the tenant has vacated the premises, so you can go in and get it ready for the next tenant.
