HOA lien on off market deal

Hi BP!

I'm trying to buy an off market property and the seller and I have an agreement for me to buy it. But I just found out the president of the HOA said this person hasn't paid his HOA dues for 5 years so around $5K and is now filing an HOA lien against him.

I'm under the impression that the deal won't close until the lien is resolved, but the seller thinks he doesn't need to pay the HOA fees because he bought the apartment before the HOA was set up.

Any advice would be greatly appreciated!

The fact that the Hoa waited 5 years to file a lien is indicative of a poorly run community I would scrutinize the financials and ask for a list of delinquent owners. I hope you are using a title and escrow company and will demand  title insurance and a clean report .
