The Occupants from Hell!

I am currently dealing with some occupants (who are no more than squatters) and getting them out so I can get in and start the rehab has been a daunting process. Typically, I get them out with cash for keys and it is never easy, but usually effective.

In this case, I purchased the property (practically stole it on price and terms)Feb 28th of this year and am still working on getting these morons out. I offered them $6k! for keys and they did not take it. I started eviction and they have used every tactic in the book to cause delays and extend the process. On the final hour before the summary judgement hearing, one of the two occupants filed for BK causing another 45 day or so delay. Unfortunately in CA, the laws, for some stupid reason, reside with occupants and not the legal owners. (I wont even get started on politics here!)

The good news is that I was able to have summary judgement against one of the occupants and already filed for the Sherriff to remove her from the premises. Should be within the next week or so for that. The kicker is that once it happens, her boyfriend still has rights to be there (until he is finally evicted) so I am quite sure she will just come right back. When that happens, I will make damn sure I make their lives as miserable as possible for the problems they have caused me. How can I do that legally you might ask? I will have periodic visits to the property and when I see she is there, I will call the Sherriff and inform them that she is illegally trespassing on my property and I want her removed/arrested. I will do this as many times as it takes until they get the point or until summary judgement against him occurs. Either way, screw them both!!!
What comes around goes around and theirs is coming.

the next court date is to finalize the argument over the punitive spouse issue and who holds title. I will also be arguing that per the court order, they pay for the holding costs to date. Assuming I win, I will then hold clear title and have the ability to file for eviction.

I am guessing he will again file BK just to delay yet again, but it should finally be able to toss him out after that (hopefully hard on his backside).

Will, this is the most incredible story I have read on bp. I wish you all the best plus cost.

Lighter note, for your movie deal - Ben Stiller plays you and Steve Buscemi plays squatter. Comedy/drama direct by Cohen brothers,

Titled " Squaters" or Squatocrates" pronounced like Socrates:)

Great idea Matt, only I am leaning towards Robert De Niro or Joe Pesci playing me with a final seen in either the corn fields or the desert with a hole about 6 feet deep.

Typical with this soap opera, the judge orders that I go after the title insurance policy which will obviously decline the claim as none of what has happened here since I purchased it ever affected title (no hidden liens, encumbrances, etc.) Title insurance specifically states that unrecorded liens are not covered under the policy. So this will be just one more exercise in wasting time.

@Will Barnard

Wow, that's a 5-minute phone call ... couldn't he have recessed and the two of you make the call from chambers?

No, that would make too much sense and save time, other than myself and my attorney, there are no brains in the room.

Negative, their stay is in full force and effect. I can't even take a dump in my own toilets there! Sorry for the vulgarity of that, just frustrated.

@Will Barnard , vulgarity may be your only possible response to this travesty. Are you making any progress on the putative spouse issue?

OMG Will, this is unbelievable. Undisclosed lien with unrecorded marriage this is insane. I can see how you would want to use the unregistered bulldozer.

Sure, the CA rattlesnake but good luck training them! I would prefer a weak python. I say weak because I would want the victims to suffer for a whole before expiring.

Well, today my boy turns three, which means the anniversary of your standoff is the end of the week. Has there been any recent progress? Is the end of the runway in-sight?

I really hope we still are not having this exchange when the boy starts school.

I'm just now catching up on this and am blown away.

@Will Barnard I have a thought, although I don't know how you'd get much traction on it since the judges seem to be a big part of the problem.

Lawyers and firms can be penalized for filing frivolous litigation. I'm wondering if at some point you can use this to your advantage.

This.. is just painful to watch. I really hope they make some progress, what an absolute joke. I think my USMC days would kick in and someone would get a midnight blanket party--at the least.

Good luck Will! The entire BP nation is pulling for you. This is way too big for the small screen. This script would get purchased for film rights instantly. - Cohen brothers dramady.

Have not seen the results of your court date from late February. While hoping you got good news, I have the feeling you have again been let down by the system.
