Neighbor's tree damage

HI;

I am in the process of rehabing my first flip. The brick fence on the back needs to be replaced and the damaged was caused by the tree thats on the back yards neighbor's property. I have been told that the neighbor should be responsible for cutting down his tree and for replacing or fixing the damaged cause to the fence. by the looks of the neighbors house this is not likely to happen but I am going to give it a try. wondering if any of you have been faced with a similar situation and if you have some advice to give.

@Mauricio Hernández The tenants cannot give you permission to do anything to the property, that's up to the property owner. Do not cut the tree based on the occupants saying they don't mind. Tree law is going to vary state to state so you'll need to look into what you can legally do and a licensed tree guy in your area could probably give you an answer with a quick phone call. Here in FL I can cut anything over the property line back but cannot go beyond that at all.
