Septic issue

I purchased a home on Hubzu late last year. Even though in AZ septic certification is required on all sales, seller did not provide and I accepted the contract as is.

Fast forward to this month. I rehabbed the home and have it under contract scheduled to close 2/28. We do our septic inspection and it turns out the plastic tank is crushed and inspection failed. The inspector told me that the bank had him perform the same inspection before the sale and he provided them with a failing report. The seller did not disclose this report or the condition of the septic. It was still a good deal and I will make money but I'm not pleased about the $3k repair.

Would you go after the seller and title company? Unfortunately I used Hubzu's garbage title company out of CA and dealing with them is very difficult. I'm not sure how they could disclaim providing the septic certification even though it is Arizona law.
