Using the name Realty in my business

Derrick Summers
Posted

Hey everyone, I’m about to become a real estate investor and I wanted to know if it’s okay to have Realty in my company name as I wholesale homes? Any help would be appreciated.

The problem would be that someone may consider it fraudulent.  It would be like calling yourself a bank if you were a hard money lender.

So, even though the word realty isn't trademarked like the word Realtor is, and you wouldn't be in trouble for trademark infringement, you could still get yourself in hot water if someone felt you had misled them into believing you were a real estate broker and that you may have intended to mislead them and part them from their money based on their misconception.  That would be fraud.  Therein lies the rub.
