Short Term Rental - minimum operating period

Domenico Geria
Posted

I have an attached ADU at my primary residence that I have mainly used to host relatives and friends when visiting, but I'm now thinking to explore the idea to offer that as STR. I'd need to go through some approval process in my County, and City, and from an initial analysis it looks like it's something I'll be allowed to do.
One caveat is that I was still hoping to keep it free for 50-75% of the time, in order not to limit my family's privacy too much, and still be able to host relatives and friends that happen to be around. So I was wondering whether there's any minimum number of nights, or monthly occupancy rate that need to be met for the property to qualify as STR, especially for taxes reasons and for me to claim active participation losses?

Thanks,

Domenico

Your deductions are going to be limited if your not making it available to rent all the time. I think 14 days is the magic number for self use before you have to start probation your deductions.

Also if you block out a chunk of your calendar on a listing platform it will hurt you showing up high in the search results.
