Evictions and the Americans with Disabilities Act (ADA)
We are trying to evict a tenant. She fell down the stairs (cracked her head open and had a pretty bad fall) and tried to sue us (she said it was ok if she sued us because our insurance would cover it). Then she said she wasn't going to sue us anymore. Since she said she was going to sue us we decided to evict her. The lease is up at the end of Jan. Now she wants to sue us AGAIN claiming that b/c of the ADA we are discriminating against her. She is currently recovering and is not in good health. We feel bad she is hurt but feel she is an unsafe person to have as a tenant (we have also seen alot of unstable behavior). Does anyone have any advice or experience with anything like this?
