Non Renewal of Lease

I have a question for the group.   I have a tenant that is 1.5 months behind in rent.  He has not lost his job during the pandemic. He has never paid on time. I was in the process of eviction before the pandemic hit.   His lease is up at the end of the month. I have sent him a "Non renewal note" and he has acknowledge receiving it.  He hinted that because of the 'no eviction' policy, he does not need to leave.  I informed him that I'm not renewing his lease... not an evicting him.   The property is in Kansas.   What are my options if he refuses to leave at the end of the month?

Let the tenant know - in writing - that you intend to prosecute to the full extent of the law if he refuses to vacate. If he insists on staying, you can file for eviction when the courts open back up and sue for every penny owed. On the other hand, if he moves out by the termination date, you will apply his deposit and forgive the remainder.

That is usually enough incentive to make him leave.
