Police being called at 3am
The downstairs tenant always complains about excessive noise from the upper unit. Last night there was a disturbance in the upper unit and the police were called at 3am. The tenant and her company was in the middle of the street arguing and fighting. The police showed up but because of COVID19 nothing happened. This is upstate NY. She is on a month to month lease but there are no eviction allowed at the moment. What can I do?

Have the downstairs tenant document the noise violations. Have him or her video the noise using a cell phone( and verbally document the date and time) and send you each video.
When you're able to evict you'll have these videos as evidence and the judge will be more likely to evict as you'll have solid proof. Also, each time the police are called get a copy of the police report as this is useful evidence as well.
