Will I be able to evict my tenant if they won't leave?
TL;DR: Can I evict a problem tenant on supportive services through HAART during the Covid-19 moratorium?
I am a new landlord and inherited a problem tenant last September. Her rent is subsidized by HAARt. She is a very difficult person in general. She is obviously on drugs as she has passed out while a contractor was there, and was unresponsive, and always seems intoxicated when I visit. While replacing her flooring, she disappeared. After a few days of not being able to reach her, I stopped by and there was a family member there picking up her kids. I asked if she knew where she was and she just said she was in a little trouble and wouldn't say anything else. Come to find out, she was arrested for ill use of a weapon and was in jail. She never called to tell us and has never even mentioned it. She said she was in the hospital in Texas. I should have evicted her then I guess. Anyways, her lease is good through May. I plan to just not renew the lease and hope she leaves. However, I expect there will be an issue and she won't leave and I just wanted to know if I would be able to evict during the Covid-19 moratorium just in case.
