Kentucky Evictions and expertise with lawyers and the KRS codes
Can someone walk me through your last KY eviction? We have communication via text...she was supposed to pay last week. I should have posted the notice to quit sooner but it got posted yesterday stating she owes me $849 rent for her lease dated 8/1/2019 for this Jan (due the 1st) and that she owes $150 in total late fees. I have texts where she acknowledges this. The notice to quit cites the KRS code and was hand delivered by me to her door where I taped it to her door and took several photos with date and time stamps. I also returned tonight and took a photo showing she had taken the letter down. The letter was also texted and emailed to tenant. This tenant has had an unauthorized adult living in the unit (using water I pay for) in addition to failure to pay rent. I posted a 7 day notice to quit a few months ago and she ended up paying.
I seriously doubt she pays this time. She sent me texts stating she has been in the hospital. I asked for dr notes and she had not sent. She also states she lost her phone yet I have daily facebook posts from her.
I already have an eviction attorney for $300 all in....he requires the lease, notice, etc...does that seem like a good price (I am not sure if includes court fee)? At what point should I retain this attorney, pay the money, and let him handle it? If I posted notice Jan 9th, can I have him start the eviction process Jan 16th? If so, how long would it take to get her out? The process is a bit different in Indiana and Florida.
