Remodeling with Dust and tenant

I am doing a remodel where I am removing plaster and laths. My up stairs tenant is complaining she is allergic to the dust and I need to remodel both bathroom before I can finish up down stairs because both bathrooms share same drain lines. My concern is some type of hospital bills or other major re-percussions. I want to give some type of legal notice that I cant get sued or she has 60 days to vacate. How does one do this ?

Let me get this straight.  You want to tell your tenant to sign a liability waiver (in Calif we call it a 1542 waiver) because of possible health and habitability issues YOU created and if she does not sign it, you want to evict her?

I highly suggest you contact an attorney before you attempt this. If you do it and she sues you, you will not have to worry about remodeling, because she will own the building. There are laws in every state (civil and criminal) that absolutely prohibit what you want to do. I see lawyers lining up to take her case as I am writing this.

There are easier ways to handle this, but since you didn't ask for alternatives, I will not supply any.

Why am I being so blunt? Because it is attitudes like yours that do damage to the industry and creates an environment that causes more Government regulation.
