Landlord turning 2-bedroom condo into 3/4-bedroom condo legal?

I know of some landlords in Houston who are turning 2-bedroom condos into 3/4-bedroom condos and renting out each of the rooms. Is this legal and what are the repercussions if this is not allowed? What are the maximum repercussions by the HOA or other entities?

I am planning to do the same and am wondering what I need to look out for. Do I just need to look at whether this is allowed in the CC&Rs of the condo HOA or do I also need to look at other things?
