Tenant Late Fees Delayed

Hi, 

I have a situation here and wanted to get you all feedback. My tenants have been delaying monthly fees for sometime now. In particular they were late in November and December for few days. Now, they have paid monthly rental fees but not the late fees. Tenants are aware of amount for late fees, and were supposed to pay them this Friday. They have told me earlier this week. I texted tenants today to follow up no answer. What would you recommend I should do next?

Are they on a term lease or M2M. If on term when does it end.  

What you do is when they pay January rent you deduct the late fees from it first. The rent for January is then short and you serve them a pay or quit notice. If they do not pay you proceed to evict. If they should pay January rent late, which is likely, serve the pay or quit notice on the 2nd.

Alternately you non renew their lease when it is up and get good tenants.

You either train them to pay on time or get rid of them.
