Texas what is the timeframe on repairs
I have been reading the chapter 92 property codes but I have also spoken to a lawyer. Lawyer says I have 7 days to action, 30 days to repair, and 60 days to repair if there is an issue coming up with materials and or labor; however,
Sec. 92.056. LANDLORD LIABILITY AND TENANT REMEDIES; NOTICE AND TIME FOR REPAIR.
States seven days to make repairs also this same seven days is mentioned in the TAR
Sec. 92.0562. LANDLORD AFFIDAVIT FOR DELAY.
the landlord delivers to the tenant an affidavit, signed and sworn to under oath by the landlord or his authorized agent and complying with this section.
Affidavits under this section may delay repair by the tenant for:
- 15 days if the landlord 's failure to repair is caused by a delay in obtaining necessary parts for which the landlord is not at fault; or
- 30 days if the landlord 's failure to repair is caused by a general shortage of labor or materials for repair following a natural disaster such as a hurricane, tornado, flood, extended freeze, or widespread windstorm.
Am I missing something was the information provided to me in the consult inaccurate? Any opinions from those more well educated is appreciated. I am just trying to study chapter 92 and learn it well.
