Landlord Liability Down Spout Utah

Hello friends, quick question on liability. I have a down spout that is hooked to a plastic pipe that goes under the driveway and empties out into a pop up emitter in the yard . This is the first winter I will have this property. Today I disconnect this and hooked up a plastic down spout that you can get at home depot or Lowe's. I did this because I was worried about the pop up emitter freezing but now I am worried about the Tennant tripping over this and the liability that this may bring. It's across the sidewalk leading to a gate to get to his vehicle. Any advise? Worried and thinking I should maybe do something different?
