Owed Rent From Previous Landlord

Hi All, 

Purchased an 8 family rental property in New Haven, CT. 6 of the units at my property are section 8. I closed on 9/20/18, and getting the Section 8 packets completed in that month was impossible. The rents for October 2018 went to the previous landlord. It has now been a month and I have not received any word from the previous landlord, nor her attorney on how I will receive the 6 owed rents, which were cashed according to the Section 8 office.  The attorney I dealt with (buyer attorney) has been in contact with the seller attorney, who says, "he's having a hard time getting in contact with her." I feel as my attorney hasn't been going after this matter in a way I expect.  

What recourse do I have here?  

  1. Can I contact the seller or her attorney directly? 
  2. Should I proceed with a lawsuit? (I am owed $5,535)

Oh please. OP is referring to October rents and a September closing. 

The issue of future rent payments would have been addressed in the contract -- if not the October and beyond funds are absolutely the buyer's, according to principles of equity -- and are surely recoverable after closing if sent to the seller.
