Eviction advice in Upstate New York

Hi all its been some time since I have posted here. Unfortunately it is for some advice about evicting a tenant. We have a tenant that told us she was going to move out because of the school district she wanted her kids in which is fine. She never did give an official date on when she would be out. She finally moved out but her stuff is still in the place! She owed us for this months rent which was never paid but she 'plans' to pay.... right I was not born yesterday. Now this is spilling into month two and the place still has her stuff in it and we told her it needs to be out and she owes us two months rent because we did not receive a time frame when she would officially be out so we could tell potential renters. She also questioned when she would get her security deposit which we left as an open conversation( because we plan to take it because of the damage to the property she has caused)

My partner has considered telling her just to pay march and use deposit as april (deposit is about 60 dollars less as this person has been there for 5 yrs as an inherited tenant) I don't believe that solves the problem but now we are afraid we won't even get march either.

What do you guys think? What is your overall process to prevent something like this from happening again ?

Tyril
