Flooded Basement due to tenant not keeping the drain clear

Quick Question: This has not happened yet but it's been on my mind a lot lately. I have a rowhouse style property in Washington, DC and the down spout for the back of the roof leads to a drain outside of the basement door. It's imperative that this drain remains clear at all times. It can handle any storm when it's clear but if any debri blocks the drain, it can fill up the patio area and flood the basement. I have discussed this with the tenant and we have had no issues. I'm just curious, if the basement were to flood due to negligence who would be responsible for the damages?
