Eviction questions and protocol
So I’m a full time landlord with 16 properties. I’ve been doing this since 2002 and have been lucky, I guess, to not have to evict anyone until now. I have a tenant that fell off the wagon into her second lease and is now 2 months behind...I already filed for eviction and have a court date on July 10. She is using drugs, has been arrested for it a couple ones the last few weeks, had her car repossessed, and has lied to me repeatedly over the last 2 months about rent and moving out. I’m completely done with her! She claims she’ll be out before the court date but she’s missed every date she’s given me...I have a few questions though. I am planning on going through with the eviction even if she texts me and says she’s out the night before court. Is this even possible? Is a text good enough? Will the eviction show on her record if she tells me she’s out before court? What will the judge say if we get to court and she says she already moved out and told me that/ I really want the legal binding of an eviction and the damages court date that comes with it. I don’t want her coming back later and saying I took possession of the property improperly or stole something or whatever. This is in Indiana and, like I said, I’ve never had to do this before. Any help is appreciated! Thanks!
