Can a tenant refuse a scheduled entry?

This is in Texas.

I have a situation where some domestic violence has occurred and the wife has told me he trashed the house.    I contacted him today and told him I was coming by for an inspection tomorrow.   He has not responded and I don't believe he will.  I went by today and tried to serve a lease termination for end of next month, since he is on month to month.  He refused to come to the door, I know he was there, because 10 minutes earlier his car had not been in the driveway.

The back door has been kicked in, and I do have a set of keys.   If he does not come to the door, I am going to gain entry one way or the other.  

What can he refuse?

It's not about being able to kick his ***. 

You want to stay within the law. If you do confront him, which it sounds like you really want to, bring a witness. 

As a landlord, your tenant can cause much more harm to you than you can to him. You stand to lose your rental and your home and future income by beating his ***. 

He will rent the place next door.

Be a business owner, not a referee.
